A judge ruled a territory Logansport has been planning to annex south of town that was contested by those living there must become a part of the city.

Logansport City Council approved the annexation of two adjoining territories totaling about 2,600 acres south of town in Cass County's Washington Township in 2013.

About 120 landowners in the southwestern territory fought the move by filing a lawsuit known as a remonstrance. The three-day trial concluded Feb. 5.

Douglas Tate, the special judge in the case, signed an order March 26 ruling the annexation to take place.

The order states the court must accept the city's fiscal plan regarding the annexation if it meets statutory requirements, adding that it does. The fiscal plan explains how the services of each municipal department will be extended to an annexation territory and the costs associated with them.

The ruling goes on to state the opposing landowners' arguments do not expose any illegality or insufficiency in the city's actions.
