Monroe County residents can expect noisy nights near the Interstate 69 construction site for the time being.

Marion Superior Judge David Dreyer granted the Indiana Department of Transportation’s request for temporary relief from Monroe County’s noise ordinance while a lawsuit challenging the ordinance makes its way through the courts.

The judge’s ruling prohibits the county from enforcing the ordinance when it comes to INDOT-related construction projects, including I-69, until further notice.

“The July 16 hearing as a whole is evidence that INDOT is the expert in matters of highway construction, including in the area of worker safety in construction zones, and it should not be forced to justify its actions — and bargain over alternatives — with the county,” the order reads.

And as far as INDOT is concerned, contractors may resume night construction, if they wish, immediately, said Will Wingfield, the department’s spokesman, though he noted night construction is not a requirement for the project.

Last month, the county revised its noise ordinance largely to address complaints about late night noise from I-69 construction sites.
